In Ontario, the difference between a Phase 1 Canadian Standards Association (CSA) and a Phase 1 Record of Site Condition (RSC) is essentially the difference between &#8220;private due diligence&#8221; and &#8220;regulatory law.&#8221;\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f9384d4 elementor-widget elementor-widget-text-editor\" data-id=\"f9384d4\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\tWhile both involve a non-intrusive investigation of a property&#8217;s history and current state, they serve different purposes and follow different rulebooks.\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-b7745fb elementor-widget elementor-widget-text-editor\" data-id=\"b7745fb\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><b>Phase 1 CSA \u2013 Due Diligence<\/b><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-aa839c9 custultext elementor-widget elementor-widget-text-editor\" data-id=\"aa839c9\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">The <\/span><b>CSA Z768-01<\/b><span style=\"font-weight: 400;\"> standard is the &#8220;business&#8221; version of an environmental assessment.<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><b>Goal:<\/b><span style=\"font-weight: 400;\"> To identify &#8220;Areas of Potential Environmental Concern&#8221; (APECs) so a buyer or lender knows if they are inheriting a mess.\u00a0<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><b>Flexibility:<\/b><span style=\"font-weight: 400;\"> The Qualified Person (QP) can use their judgment to determine which records to check. Reg. 153\/04<\/b><span style=\"font-weight: 400;\"> standard is a legal document required by the Ontario Ministry of the Environment, Conservation and Parks (MECP).\u00a0<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-4b58ae7 custultext elementor-widget elementor-widget-text-editor\" data-id=\"4b58ae7\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<ul><li style=\"font-weight: 400;\" aria-level=\"1\"><b>Goal:<\/b><span style=\"font-weight: 400;\"> To prove a site is safe for a more &#8220;sensitive&#8221; use (like turning an old warehouse into condos).<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><b>The &#8220;Checklist&#8221;:<\/b><span style=\"font-weight: 400;\"> Unlike the CSA version, the RSC version is <\/span><b>not flexible<\/b><span style=\"font-weight: 400;\">. The law dictates exactly how many years of title search are required (usually 25+), which databases must be checked (often 60+), and who must be interviewed.\u00a0<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><b>Mandatory Phase 2:<\/b><span style=\"font-weight: 400;\"> If a Phase 1 RSC identifies a &#8220;Potentially Contaminating Activity&#8221; (PCA), you <\/span><b>must<\/b><span style=\"font-weight: 400;\"> proceed to a Phase 2 ESA (soil\/water testing) to file the Record of Site Condition.\u00a0<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><b>Public Record:<\/b><span style=\"font-weight: 400;\"> Once filed, the RSC is posted on the Environmental Site Registry for anyone to see.<\/span><\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7f1b1c0 custultext elementor-widget elementor-widget-text-editor\" data-id=\"7f1b1c0\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><b>Note:<\/b><span style=\"font-weight: 400;\">\u00a0<\/span><\/p><ol><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">You cannot easily &#8220;upgrade&#8221; a CSA report to an RSC report later. If there is even a small chance you will need an RSC (e.g., for future rezoning), it is often cheaper to do it to the RSC standard from the start.\u00a0<\/span><\/li><li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Phase 1 reports, either CSA or RSC, are typically valid for 18 months from time of assessment.<\/span><\/li><\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t","protected":false},"excerpt":{"rendered":"<p>Phase 1 Environmental Site Assessment There are two distinct types of Phase 1.
