(RSC)<\/b><span style=\"font-weight: 400;\"> is an official legal document filed with the Ministry of the Environment, Conservation and Parks (MECP) that certifies the environmental health of a property. It is governed by <\/span><b>Ontario Regulation 153\/04<\/b><span style=\"font-weight: 400;\">.\u00a0<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d64715e elementor-widget elementor-widget-text-editor\" data-id=\"d64715e\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">An RSC summarizes the results of <\/span><b>Environmental Site Assessments (ESAs)<\/b><span style=\"font-weight: 400;\"> conducted by a <\/span><b>Qualified Person (QP)<\/b><span style=\"font-weight: 400;\"> (a licensed Professional Engineer or Geoscientist). It confirms that the soil and groundwater on the property meet the provincial standards for its intended use.\u00a0<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-860bce7 list-ul elementor-widget elementor-widget-text-editor\" data-id=\"860bce7\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">The process generally involves two main stages:<\/span><\/p><ul><li style=\"font-weight: 400;\" aria-level=\"1\"><b>Phase One ESA:<\/b><span style=\"font-weight: 400;\"> A historical review of the property to identify if past activities (like a gas station or factory) might have caused contamination.\u00a0<\/span><\/li><li aria-level=\"1\"><b>Phase Two ESA:<\/b><span style=\"font-weight: 400;\"> If risks are found, the QP conducts actual physical testing (drilling and sampling) of the soil and water. If contamination exceeds safe levels, the site can be <\/span><b>remediated<\/b><span style=\"font-weight: 400;\"> (cleaned up) or undergo a <\/span><b>Risk Assessment<\/b><span style=\"font-weight: 400;\"> before an RSC can be filed.<\/span><\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8ba6d89 elementor-widget elementor-widget-text-editor\" data-id=\"8ba6d89\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>The RSC is a critical hurdle in Ontario\u2019s real estate and development sector for three primary reasons:<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-5f88843 elementor-widget elementor-widget-text-editor\" data-id=\"5f88843\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><strong>A. Legal Requirement for &#8220;Change of Use&#8221;<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1f057e8 elementor-widget elementor-widget-text-editor\" data-id=\"1f057e8\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>The most common trigger is a change to a more sensitive land use. You cannot legally switch a property&#8217;s use from industrial or commercial to residential, institutional (like a school), or parkland without a filed RSC. Municipalities will generally refuse to issue building permits until the RSC appears on the public <strong>Environmental Site Registry<\/strong>.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f78c446 elementor-widget elementor-widget-text-editor\" data-id=\"f78c446\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><strong>B. Liability Protection<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-15dc13c elementor-widget elementor-widget-text-editor\" data-id=\"15dc13c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Once an RSC is filed, the property owner (and future owners) receives statutory protection from certain environmental orders. This means the Ministry cannot later order you to clean up contamination that existed before the RSC was filed, provided the filing was accurate.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-25b94bf elementor-widget elementor-widget-text-editor\" data-id=\"25b94bf\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Note: This protection does not stop third-party lawsuits or cover contamination that migrates off-site.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-382b4a9 elementor-widget elementor-widget-text-editor\" data-id=\"382b4a9\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><strong>C. Financing and Risk Management<\/strong><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-845d495 elementor-widget elementor-widget-text-editor\" data-id=\"845d495\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p>Banks and lenders almost always require an RSC before providing a mortgage or construction loan for a former industrial site.
